Northeastern Taverns Ordered To Pay more than $6M to Drunk Driver

A Northeastern Pennsylvania man who became a paraplegic after driving while intoxicated and crashing into a tree has been awarded $6.6 million. The settlement involves two East Stroudsburg bars – Pub and Sticks N Stones Bar & Grill – who were found ultimately responsible for the accident, despite the fact that the man was driving alone. According to his attorney, the plaintiff in the case will receive $5.65 million from Pub 570 and $950,000 from Sticks N Stones. The Attorney filed a federal action lawsuit against the two establishments after the incident which occurred in 2010.

The lawsuit alleged that bartenders at the taverns gave him several shots and drinks at no charge before letting him drive home. According to a settlement memo both bar owners had applied for a liquor license through the Pennsylvania Liquor Control Board and had claimed to the Board at that time that they would personally be managing their respective establishments. But the Attorney claimed that neither of the owners was present at their bars the night of the 2010 accident and that he was served free drinks by several inexperienced staff members.

The case proved a very challenging one to try, particularly for attorneys representing the Plaintiff. Since the jury found him to be less than fifty percent at fault he was awarded the settlement. If he had been found more than fifty percent at fault, however, he would have received nothing. In the suit, the Plaintiff claimed he suffers from constant pain in his arms and legs and now requires 24-hour care for including everything from getting dressed to brushing his teeth to using the bathroom and bathing.
