Comm. v. K.V. - Pittsburgh Aggravated Assault, Disorderly Conduct, Resisting Arrest - ARD Program

Defendant was in Pittsburgh as a Pittsburgh College Student and originally from Philadelphia. One evening the Defendant was intoxicated and smoking marijuana. The Defendant was unknowingly passed a marijuana blunt that had been "laced" with heroin. After ingesting the heroin laced marijuana, the Defendant began hallucinating and ran naked across the campus and through the local Pittsburgh Neighborhood.

Upon contact with the authorities, the Defendant began to resist arrest and allegedly fought with police officers. The Defendant was arrested, taken to the Allegheny county jail and charged with three counts of Aggravated Assault, Resisting Arrest and Disorderly conduct.

The Defendant withdrew from school and enrolled in school closer to his home in Philadelphia. As a student, the Defendant did not have adequate resources for multiple trips back to Pittsburgh for the formal Arraignment, Pre-Trial conference and Trial. Further, the Defendant could not risk having a felony on his record or jail time.

The Defendant contacted our office and Attorney Walker was able to negotiate a dismissal of the felony counts and entry of the Defendant into the ARD program. Upon successful completion of the program, the Defendant would be eligible for an expungement.
